Sunset on 05. December 2007.
In my imagination the branches of that tree were sparkling... that effect can be achieved by excessive usm sharpening.

The camera's view of the scene :| is posted to the ws.

I totally agree with you: it is your photograph, you are free to make it look as you wish. Now, because the workshop is mine, this is my way of thinking of this photo, with the tree as the main subject and breaking all the rules by making it darker and less colorful than the rest of the image.
I made the foreground lighter,so now I can add some saturation there. The dark areas of the photo are almost totally colorless.
The sky is a color explosion and because I applied a Gaussian blur to the L channel in Lab on Overlay mode,the photo looks a bit more "dreamy".
Not better,not worse, just my own thought...

With Photomatix Pro3.1

-I made 5 copies of your Original Raw
-Manually, I change different exposure values: -1. -0.5, 0, 0.5 and 1
-I processed them with Generate HDR options and
tones mapping.

-With PS CS3

-I finished with contrast, light saturation and
sharpen.Copy and paste in your frame.

The image would be better using the large file!
